Temporary night work

The notion of temporary night work implies that the workers in question have been contracted out to carry out their work during the day or in the evening, and, under exceptional circumstances, they are told to work during the night. In such a case, workers shall be paid a 25% premium for the period of time worked during the night - between 23h00 and 06h00. Breaks during which they are free to do as they wish are not included as working time andtherefore do not give themthe right to basic pay or the premium.

However, if against all odds the number of nights worked exceeds 24 in any given calendar, workers shall be awarded compensation in the form of paid leave equalling 10% of the time worked during night hours, in accordance with the article hereinunder. The number of nights worked for other employers shall be taken into account to determine the number of nights worked and therefore the change in the regime (payment of a 35% premium or compensation in the form of paid leave equalling 10% of the time worked).
